Terms of Service

These Terms of Service (“Terms”) govern your use of niramaya.health and any nutrition consultation or program (“Services”) offered by Niramaya Health (“Niramaya”, “we”, “us”). By using the site or booking a Service, you agree to these Terms.

1. Nutrition guidance, not medical advice

Niramaya provides personalized nutrition and lifestyle guidance from qualified clinical dietitians. We are not a substitute for medical care. Our guidance does not diagnose, treat, cure, or prevent any disease. Always consult your physician before making changes to medication, treatment, or care plans, particularly if you are pregnant, lactating, managing a chronic condition, or taking prescription drugs. In a medical emergency, contact your local emergency services immediately.

2. Eligibility

You must be at least 18 years old to book a consultation on your own behalf. A parent or legal guardian may book on behalf of a minor and is responsible for the minor's information and use of the Services.

3. Booking, fees, and cashback

• Programs are offered in tiers ranging from 30 days to 6 months, starting at ₹1,999 inclusive of applicable taxes unless stated otherwise at checkout. Current pricing for each tier is shown on the booking page.
• You may earn up to ₹3,000 cashback (the exact amount depends on the program you choose) by completing the milestones and adherence criteria communicated to you at the start of the program. Cashback is paid out at the end of the program to the original payment method or as a credit toward future programs, at our discretion.
• Booking creates a non-binding request. Niramaya reserves the right to decline or reschedule any consultation, in which case any amount paid will be refunded in full.

4. Refunds and cancellations

• You may cancel before your first consultation for a full refund.
• Once the first consultation has taken place, refunds are issued at Niramaya's discretion on a pro-rata basis, less any cashback you have already earned.
• If we cancel a Service for any reason and cannot reschedule to a time that works for you, you'll receive a full refund.

5. Your responsibilities

• Provide accurate, current, and complete information when booking.
• Disclose relevant medical history, medications, and allergies so we can build a safe plan.
• Use the Services for personal, non-commercial purposes only.
• Not share, resell, or redistribute personalized plans or program materials.

6. Intellectual property

The site, brand, content, plan templates, recipes, and program materials are owned by Niramaya or our licensors and are protected by copyright and other intellectual-property laws. You receive a personal, non-transferable license to use materials provided to you as part of your program. All other rights are reserved.

7. User content

If you share testimonials, photos, lab reports, or other content with us, you grant Niramaya a worldwide, non-exclusive, royalty-free license to use that content for the purpose of providing your program. We will not publish identifiable content (name, face, or health details) without your separate written consent.

8. Disclaimers

The site and Services are provided "as is" and "as available". To the fullest extent permitted by law, Niramaya disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific health outcome — individual results vary based on adherence, biology, and circumstances outside our control.

9. Limitation of liability

To the maximum extent permitted by law, Niramaya, its team, and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the site or Services. Our aggregate liability for any direct damages will not exceed the amount you paid Niramaya in the 12 months preceding the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Niramaya from any claim, damages, or expenses arising from your breach of these Terms or your misuse of the Services.

11. Governing law and disputes

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.

12. Changes to these Terms

We may update these Terms from time to time. The "Effective" date at the top of this page reflects the most recent revision. Continued use of the site after a change constitutes acceptance of the new Terms.
